Brett Kappel responds to Trump’s latest statements on Jimmy Kimmel and federal campaign finance law in a recent Forbes article

The article titled “Trump Threatens Lawsuit Over ABC Resuming Kimmel – Here’s Why His Claims About Campaign Finance Are False” written by Alison Durkee and published by Forbes on September 24, 2025, examines the facts surrounding this recent assertion by the president. Following Jimmy Kimmel’s talk show suspension and subsequent resumption, Trump claimed that Kimmel’s criticism violated FEC regulations. However, Brett Kappel states that Kimmel’s comments are “clearly covered by the ‘media exemption’” in campaign finance law. The article goes on to explain the media exemption Kappel refers to “…was created in order to preserve the freedom of the press and ensure ‘the unfettered right of the newspapers, TV networks, and other media to cover and comment on political campaigns,’ the FEC has noted, and allows media coverage to be exempted from being considered as political contributions or expenditures.” As of this publication, no litigation has been filed against ABC or Kimmel regarding these false claims.
